All material on these platforms, including, but not limited to, images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by The National FZ LLC, its related companies or by other parties that have licensed their material to The National FZ LLC. CONTRIBUTIONS TO INTERNATIONAL MEDIA INVESTMENTS FZ LLC The digital platforms may contain discussion forums, bulletin boards, video and photograph boards, review services or other forums in which you or third parties may post contributions, both current and historical, including reviews, messages, materials or other items on the Website ("Interactive Areas"). Where The National FZ LLC provides such Interactive Areas, you are solely responsible for your use of such Interactive Areas and may only use them at your own risk. COMPETITION AND VOTING TERMS AND CONDITIONS The National FZ LLC may from time to time run competitions, free prize draws and/or other promotions (together "Competitions") on the Website. Any such entries will be invalid. For the avoidance of doubt, under no circumstances will The National FZ LLC be liable to reimburse anyone for any expenses incurred in participating in a Competition, nor will any refunds be made for the cost of participating in any Competition. You will be required to register certain details in order to participate in the Competition. You agree that all information and details provided are true, accurate and up to date in all respects and at all times. The National FZ LLC reserves the right to ask for proof of age and evidence to verify the identity of entrant participant at any time and may use any channels and methods available to carry out checks of any details provided. By participating in a Competition you accept that The National FZ LLC may use your personal information for its own purposes including but not limited to fulfilling your requests for products and services, contacting you, conducting research, and sending you marketing email and SMS messages from the brands associated with the Competition. Each participant in a Competition will be entitled to one prize/gift per person unless otherwise stated. The winner(s) will be selected in accordance with the information specified on the digital platforms. The winner(s) will be notified, as soon as reasonably practical after the winning entry has been selected, or within such other time period as may be specified on the Website, on the phone number or email address provided when participating in the Competition. The winner will have a specified fixed time period in which to claim the prize/gift. Failure to respond within the fixed time period as specified and/or provide an address for delivery of the prize/gift (where applicable) may result in forfeiture of the prize/gift and The National FZ LLC reserves the right to offer the prize/gift to the next eligible participant and thereafter until a winner is found. Failure to comply with this requirement may result in forfeiture of the prize/gift. Where the prize necessitates travel on a specific date, the winner (and their companion(s) if applicable) must be able to travel on the date specified by The National FZ LLC LLC and the sponsors and no alternative dates will be available. Where the prize involves travel on a date and/or destination to be chosen by the winner, the date and/or destination chosen is subject to availability and The National FZ LLC and the sponsors reserve the right to include a final date by which the prize must be taken. The winner is solely responsible for all insurance, applicable taxes and for any costs, expenses and charges not specified in the prize/gift description or the Competition information. Any Votes which are incomplete, incorrect, inaudible, incomprehensible, or not received by The National FZ LLC will be void. In the event of any fault, mistake, misunderstanding or dispute concerning the correctness or acceptability of any Vote submitted by an entrant, or the operation of any part of the competition, network or phone system, the decision of The National FZ LLC and/or its appointed representatives shall be final and no correspondence regarding such disputes will be entered into. The National FZ LLC and its appointed representatives reserve the full right to overrule or reject any Vote submitted. The National FZ LLC and its appointed representatives reserve the right to cancel or suspend voting at any time, without giving any prior notice. The National FZ LLC and its appointed representatives will not be responsible if a Vote cannot be submitted due to the digital platforms being unavailable or inoperable. The National FZ LLC and its appointed representatives reserve the right to disqualify Votes if any one of them has reasonable grounds to suspect that fraudulent voting has occurred or if any one of them considers that there has been any attempt to rig the voting. The National FZ LLC and its appointed representatives reserve the right, at their sole and absolute discretion, to rule on any unforeseen circumstances or circumstances beyond their control in any way The National FZ LLC and its appointed representatives deem appropriate (including the cancellation or postponement of the Vote or changes to these Voting Terms and Conditions) in order to reach what they consider to be an equitable solution for the entrants. You acknowledge that any reliance upon any such facts, advice, opinions, views, statements, recommendations, or other information is at your sole risk. The National FZ LLC makes no representation or warranty whatsoever regarding the suitability, functionality, availability or operation of the digital platforms. The digital platforms may be temporarily unavailable due to maintenance or malfunction of computer equipment. The National FZ LLC does not warrant that the digital platforms will be uninterrupted or error-free, that defects in the digital platforms will be corrected, or that the digital platforms or the servers that make them available are free from viruses or other harmful components. The National FZ LLC and its appointed representatives will take all reasonable measures to ensure that Competition and Voting is provided using reasonable skill and care. However, no warranties are made whatsoever in relation to the accuracy, suitability, reliability, completeness or otherwise of the information or Competition or Voting itself, nor in relation to disruptions, delays or errors in connection with the digital platforms or the internet, including but not limited to any acts or omissions made by any telecommunications service provider with whom you have contracted to gain access to the digital platforms, all of which The National FZ LLC shall accept no responsibility for (without limitation). LIMITATIONS OF LIABILITY Under no circumstances, including, but not limited to, negligence, shall The National FZ LLC be liable to you for damages of any kind whether based in tort, contract, strict liability or otherwise, including, without limitation, any direct, indirect, incidental, special, punitive, exemplary or consequential damages resulting from or in connection with: INDEMNITY You shall indemnify and hold The National FZ LLC and its affiliates and each entity's directors, officers and employees harmless in respect of any claim, loss, liability, damage or expense (including reasonable legal fees and expenses) arising out of or in connection with: PRIVACY The National FZ LLC respects the privacy of its digital platform users. GOVERNING LAWS This Terms of Use shall be governed by and construed in accordance with the laws of the United Arab Emirates and the parties agree that any legal actions, proceedings or disputes related to use of the digital platforms and these Terms of Use shall be submitted to the exclusive jurisdiction of the Courts of Abu Dhabi, United Arab Emirates. MISCELLANEOUS If any provision of these Terms of Use is held to be unlawful, void or unenforceable, the remaining provisions of the agreement will remain in place.
