ABU DHABI // The Cassation Court has approved the conviction of a pedestrian run over by a motorist, and the acquittal of the motorist.
The Jordanian motorist was accused by prosecutors of speeding, negligence and reckless driving that caused him to crash into the an Egyptian boy and injuring him.
The boy was also accused of not abiding by traffic laws because he was jaywalking when he crossed the road while the pedestrians traffic light was red.
The First Instance Court acquitted the Jordanian motorist and convicted the boy and sentenced him to be disciplined by his parents.
Unsatisfied with the verdict, Public Prosecution appealed, but their appeal was rejected.
So they referred the case to the court of cassation, objecting to the acquittal of the motorist on the grounds that he was speeding and that caused the accident. Therefore, the earlier court should have attributed the responsibility of the accident to both defendants.
The cassation court dismissed the argument saying there was no evidence to prove that he was over-speeding. And the cause of the accident was the jaywalking of the boy, it added.
Therefore, the cassation was rejected and the first instance verdict was upheld.
